TRANSNATIONAL GOVERNMENT OF TAMIL EELAM (TGTE)'s SIXTH AMENDMENT INITIATIVE AN IMPORTANT STEP TO EELAM TAMILS’ SELF DETERMINATION

Prominent International Human Rights lawyer, Professor Francis Boyle of the University of Illinois in the United States of America,signed the Petition today demonstrating his legal representation and solidarity to the Transnational Government of Tamil Eelam (TGTE) initiative of challenging the 6thAmendment to the Sri Lankan Constitution. The petition challenges the 6th Amendment,which criminalizes peaceful advocacy for an independent state in Sri Lanka,as a violation of the Tamil people’s freedom of speech and freedom of conscience.

Professor Boyle won two Orders from the International Court of Justice (the World Court of the United Nations System) overwhelmingly in favor of the Republic of Bosnia and Herzegovina against Yugoslavia to cease and desist from committing all acts of genocide against the Bosnians in violation of the 1948 Genocide Convention.

He also convinced the Prosecutor of the International Criminal Tribunal for the Former Yugoslavia to indict Yugoslav President Slobodan Milosevic for every crime in the ICTY Statute, including two counts of genocide: (1) genocide for the Srebrenica Massacre; and (2) genocide against Bosnia in general.

He is the author of several books on self-determination and genocide among others. He has presented many papers and booklets on the Tamil national conflict the latest of these being a book titled ‘The Tamil Genocide by Sri Lanka: The Global Failure to Protect Tamil Rights under International Law’ published first in 2009”.

While signing the TGTE’s communication to be filed with the UN Human Rights Committee Professor Boyle quoted Article 1 of the International Covenant on Civil and Political Rights, a treaty to which Sri Lanka is a party, and stated ‘all peoples have the right to self-determination and that includes the Eelam Tamils’.

‘The right to self-determination for the Eelam Tamils is at stake here and that is certainly why I am going to sign and why I would encourage all my legal colleagues to sign. This is an extremely important initiative, a breakthrough initiative, and I think everyone has to be behind it. And so now I will sign this Petition and I would encourage you to do so’ said Boyle, as concluded the signing ceremony.

BACKGROUND:

Tamils in the island of Sri Lanka faced repeated mass killings in 1958, 1977, and 1983 and the mass killings in 2009 prompted UN Secretary General Ban Ki-moon to appoint a Panel of Experts to report on the scale of the killings.

According to UN internal review report on Sri Lanka, over 70,000 Tamils were killed in five months in early 2009 and Tamil women were raped by the Sri Lankan Security forces. There are over 90,000 Tamil war widows and thousands of Tamils disappeared due the conflict.

According to this UN report, the killings and other abuses that took place amount to war crimes and crimes against humanity. Independent experts believe that there are elements of these abuses that constitute an act of genocide.

Members of the Sri Lankan security forces are almost exclusively from the Sinhalese community and the victims are all from the Tamil community.

A Buddhist Monk shot and killed a Sri Lankan Prime Minister 1959 for having talks with Tamil political leaders.

Tamils overwhelmingly voted in a Parliamentary election in 1977 to establish an independent and sovereign country called Tamil Eelam. This Parliamentary election was conducted by the Sri Lankan Government
